The following Terms & Conditions, together with the information on our webpage, www.kaoukitours.com and your holiday confirmation email, form the basis of your contract with Kaouki Tours. Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these Terms & Conditions and agree to them.
All references in these holiday Terms & Conditions to “holiday”, “booking”, “contract”, “package”, “tour”, “retreat”, “event”, “activity”, “workshop / class”, “transport” or “arrangements” mean such holiday arrangements unless otherwise stated.

In these Terms & Conditions, “you”, “yours”, “customer”, “guest”, “client”, “participant”, “person” or “traveller” means all the people named on the booking (including anyone who is added or substituted at a later date). “We”, “us”, “the company” and “ours” means Kaouki Tours.
SPECIAL NOTE: LAND ONLY ARRANGEMENTS
Your holiday does not include flights arranged by us. Your flight operator will have their own Terms & Conditions. We hold no responsibility for flight cancellations or delays. Kaouki Tours abides by the laws in jurisdiction of the Kingdom of Morocco.
1 BOOKING, TRAVEL CONFIRMATION & CONTRACT BASIS
1.1 Bookings are made by contacting us by email.
1.2 All bookings are subject to these conditions (other conditions may apply to specific tours and will be emailed to you if applicable).
1.3 The first named person on the booking must be 18 years old or over, and also be a parent or guardian for all party members who are under 18 years old.
1.4 The first named person is responsible for making all the payments due to us.
1.5 Subject to availability, we will confirm your booking by issuing a booking confirmation invoice and, where applicable, your holiday itinerary.
1.6 Please check that the invoice and itinerary are correct before you pay the deposit.
1.7 We cannot accept any liability if we are not notified of any inaccuracy within 14 days of issuing a confirmation invoice.
1.8 We will send you a client information form with your booking confirmation invoice and itinerary.
1.9 This form must be completed and returned before travel.
1.10 We require each traveller’s full name, address, date of birth, passport number, travel insurance confirmation and policy details, dietary needs, emergency contacts (two people), and flight information.
1.11 Once the deposit and completed form have been received, the holiday is confirmed, and the contract between us is materialised.
2. PAYMENT
2.1 In order to confirm your holiday, a non-refundable deposit of 30% of the total holiday cost must be paid.
2.2 If you cancel your holiday, your deposit will be held as credit towards another booking with Kaouki Tours.
2.3 The new booking must be confirmed within 6 months of cancellation, and travel completed within 18 months.
2.4 Full payment must be received no later than 4 weeks before your arrival, unless otherwise stated on your confirmation invoice.
2.5 Payment options will be provided with your booking confirmation, itinerary, and client information form.
3. CANCELLATIONS & CHANGES
3.1 Each retreat or group tour has a different minimum number of participants required to proceed.
3.2 This minimum will be clearly stated at the time of booking.
3.3 Kaouki Tours reserves the right to cancel the trip if the minimum number is not met, up to 30 days before departure.
3.4 You will be offered a full refund or the option to transfer your payment to another Kaouki Tours trip.
3.5 We strongly recommend purchasing comprehensive travel insurance, including trip cancellation and medical/repatriation coverage.
3.6 If you cancel, we must receive written notice via email.
3.7 Cancellation charges apply as follows (based on the total cost in EUR or GBP as invoiced):

70 days or more: Deposit only (non-refundable, transferable as per clause 2.2)

69 – 43 days: 50%

42 – 31 days: 75%

30 days – day of departure or later: 100%
3.8 You may transfer your place to another person up to 14 days before departure, subject to a name-change fee of €120 / £100.
3.9 Once paid, a new confirmation will be issued.
3.10 If you miss a class or workshop booked through us, no refunds will be issued under any circumstances.
4. INSURANCE, PASSPORT, VISA & HEALTH
4.1 Travel insurance is mandatory for all multi-day tours and retreats.
4.2 Policy details must be provided before departure.
4.3 Travellers are responsible for obtaining all required documents and complying with all customs and visa regulations.
4.4 Kaouki Tours holds no responsibility for consequences resulting from non-compliance.
4.5 Passports must be valid for the duration of your stay.
4.6 For some nationalities, a 6-month validity from the date of exit may be required.
4.7 Check your country’s current entry requirements on the Moroccan Embassy website.
4.8 Ensure you are aware of recommended vaccinations and health precautions before travel.

5. ACCOMMODATION
5.1 Accommodation for private tours will be arranged according to client preferences.
5.2 On retreats, rooms are typically shared twin rooms unless otherwise specified.
5.3 Clients requesting single occupancy will be charged a supplement, where available.
6. NO SMOKING POLICY
6.1 Smoking is not permitted in our vehicles.
7. BEHAVIOUR
7.1 Clients are responsible for any damage caused by themselves or members of their party.
7.2 Payment must be made directly to the affected party.
7.3 Respect and consideration for others is expected at all times.
8. RETREAT ACTIVITIES & PHYSICAL PARTICIPATION
8.1 Clients must comply with all safety instructions and ensure they are physically and medically fit to participate in any included activities.
8.2 We strongly advise consulting a doctor before engaging in physical sessions such as yoga, hiking, surfing, cycling, or similar retreat-based experiences.
8.3 Kaouki Tours is not liable for injuries sustained during participation in any activity.
8.4 All clients must complete a health and experience questionnaire before attending physical sessions or excursions included in their retreat.
9. FORCE MAJEURE
9.1 Kaouki Tours shall not be held liable for delays or failure in performance due to circumstances beyond our reasonable control (e.g., natural disasters, war, travel bans, pandemics, or government actions).
9.2 Refunds or rescheduling will be offered at our discretion, subject to supplier availability.
10. PRIVACY POLICY
10.1 By making a booking and travelling with Kaouki Tours, you agree to our Privacy Policy.
10.2 Your personal information will only be used to communicate about your trip or send updates.
10.3 We do not share personal data with third parties.
11. COPYRIGHT
11.1 All content on our website is protected by copyright and may not be used without written permission.
12.TRANSPORT & DRIVERS
12.1 All transportation provided as part of your holiday is arranged through professional, licensed drivers.
12.2 While we strive for punctuality, Kaouki Tours is not liable for delays caused by traffic, weather, or unforeseen road closures.
12.3 Clients must respect the driver and the vehicle. Any damage caused by clients may be subject to charges.
12.4 Smoking and consumption of alcohol are not permitted in any vehicle used on tour.
13. OPTIONAL EXTRAS / THIRD-PARTY BOOKINGS
13.1 Kaouki Tours may help facilitate the booking of external services such as hammams, balloon rides, workshops, or restaurant reservations.
13.2 These services are provided by independent operators, and Kaouki Tours is not responsible for their delivery, safety standards, or cancellation terms.
13.3 Clients must liaise directly with the provider in case of any issues or disputes.
14. PHOTOGRAPHY & MEDIA
14.1 Kaouki Tours may take photographs or videos during tours or retreats for promotional purposes.
14.2 By joining a tour, you consent to the use of your image for marketing materials unless you explicitly request otherwise in writing before your trip.
14.3 We respect your privacy—please inform us if you do not wish to be included in any photographs or videos.
15. SPECIAL REQUIREMENTS & ACCESSIBILITY
15.1 We aim to accommodate special dietary needs or mobility concerns when possible.
15.2 All requests must be communicated in advance and confirmed in writing. We cannot guarantee availability of special arrangements unless previously agreed.
15.3 Clients are responsible for ensuring they are fit and able to join the selected itinerary, particularly in rural, mountainous, or remote areas.
16. CAMEL RIDES & QUAD BIKING
16.1 Camel rides and quad biking are optional activities often arranged through trusted third-party providers.
16.2 These activities are undertaken at the client’s own risk. Kaouki Tours is not liable for injuries or accidents that occur during participation.
16.3 Clients must follow all safety instructions given by the provider and ensure they are physically fit to participate.
16.4 Quad biking is not suitable for children under 14 years old to drive. Children under 14 may ride as a passenger with a parent or guardian on a shared quad. Drivers must generally be at least 16 years old. All participants must follow provider requirements and sign a waiver where applicable.
These Terms & Conditions may be updated periodically. Clients will be notified of any material changes before travel.
